DMCC Compliance

Choose how you disclose reservation fees on your listings. The DMCC Act 2024 requires transparency — we make it easy.

🛡️ Your Default Compliance Mode

This sets the default for all new reservation agreements. You can override it per agreement if needed.

Recommended

Mode 1 — Listing-Disclosed

Reservation fee is disclosed in your property listings as a buyer premium. Full DMCC compliance. Maximum vendor retention power.

  • Every buyer commits financially — strongest vendor pitch
  • Fee disclosed upfront — fully DMCC compliant
  • Works for ALL buyers (referred + walk-in)
  • Requires adding our template to your listings
Easy Start

Mode 2 — Voluntary

Fee is structured as a deposit toward purchase price. No listing changes required. Lower friction for getting started.

  • Zero listing changes needed
  • Buyers opt in voluntarily
  • All referred buyers count as opted in
  • Slightly weaker vendor retention pitch

📋 Listing Template Wording

Copy this text and add it to your Rightmove/Zoopla listing descriptions. One-time setup — paste it into your CRM listing template and every new listing inherits it automatically.

This property uses PurchaseSecured FCA-Regulated Reservation Fee: a reservation fee is payable upon offer acceptance, held in held securely by our payment provider (FCA Authorised Payment Institution). The fee is fully refundable per the conditions framework if the seller withdraws or material issues are discovered. Fee amount will be confirmed by the estate agent before any commitment is made. This fee counts as a buyer premium and is separate from the purchase price. For full details visit purchasesecured.com

⚖️ DMCC Act 2024 — What You Need to Know

The Digital Markets, Competition and Consumers Act 2024 came into force on 6 April 2025. It replaced the old Consumer Protection Regulations and is now enforced by the Competition and Markets Authority (CMA).

Key facts for estate agents:

• Mandatory fees must be in the headline price. If a buyer must pay a reservation fee to purchase a property, that fee must be disclosed in the listing. This is the "drip pricing" prohibition.

• The CMA can fine without going to court. Fines up to £300,000 or 10% of global turnover, whichever is greater. Criminal penalties up to 2 years imprisonment for individuals.

• The CMA monitors listings directly. They don't need a buyer complaint — they actively check Rightmove and Zoopla.

• No sector-specific exemptions for property. The CMA has explicitly refused to create exceptions for estate agents.

• Omissions are automatically unfair. Under the DMCC, failing to disclose material information is automatically an unfair commercial practice — regardless of whether it affected the consumer's decision.

Mode 1 keeps you fully compliant. Mode 2 is a safe alternative for voluntary fees that don't need listing disclosure. PurchaseSecured handles the compliance for you — just pick your mode and follow the toolkit above.
